53 Dock — Terms of Use

These terms are the agreement between you and 53DOCK LLC ("we", "us") for using the 53 Dock app. Using the app means you accept them.

1. What 53 Dock is

53 Dock lets commercial drivers rate shipping and receiving facilities — how long they took to load or unload, what the entrance and backing are like, whether there are restrooms, whether you can park overnight — so the next driver knows what they are pulling into.

Reading is open to everyone. You only need an account to write.

2. Who can use it

You must be 18 or over and a working commercial driver, or otherwise have a genuine reason to be here. One account per person.

You are responsible for what happens under your account. Pick a password you do not use anywhere else, and tell us if you think someone else has got into it.

3. Writing a review — the rules

These exist because the app is only worth anything if drivers can trust it.

A review must be your own experience. You were at that dock. You are describing what happened to you. Not something you heard, not something you read, not somewhere you have never been.

Report the time honestly. Count from your appointment time, not from when you arrived. If you rolled in three hours early and sat, that is not the dock's fault, and the app asks whether you were on time so it can leave your wait out of their average. Say you were late when you were late.

Rate the facility, not the person. Please leave staff names out of your review. We may remove a review that names or singles out a specific person.

Do not post:

Do not create facilities that do not exist, and do not add the same one twice on purpose.

One review per dock. You can edit or delete yours whenever you like.

4. What we can do about content

We do not tolerate abusive content or abusive users. A review with slurs, threats or harassment is removed, and the account that posted it can be closed.

We can remove any review, any facility, or any account that breaks section 3 — with notice where we reasonably can, and without it where the content is seriously harmful.

Reviews are checked automatically as they are posted. One containing a slur, a threat, a phone number, an email address or a link will not post until it is changed, and swear words are hidden with stars.

That check is automatic, and no person reads a review before it appears. It will not catch everything, so something wrong or unfair can be visible for a while before we see it. That is what reporting a review is for.

5. If you are a facility

If a review about your facility is inaccurate or breaks the rules in section 3, email support@53dock.com with the facility, roughly when the review appeared, and what is wrong with it. We will look at it.

We will not remove a review simply because it is unflattering. A driver describing a genuinely long wait is the app working as intended. We will remove content that is false, abusive, names an individual, or breaks the other rules.

We will not tell you who wrote a review.

6. Reviews are drivers' opinions, not ours

Every rating, time and comment in 53 Dock was written by an individual driver describing their own visit. They are that driver's statements, not ours. We host them; we did not write them and we do not verify them.

Averages, medians and counts are worked out from what drivers reported. They describe the drivers who happened to report, which may not be typical.

Do not make decisions that matter purely on what this app says. It is one source of information about a dock, gathered from other drivers.

7. Your content stays yours

You keep ownership of what you write. By posting it you give us permission to show it in the app and to include it in the averages and counts on a facility's page. That permission ends when you delete the content, except for copies sitting in routine backups until they age out.

8. The app comes as it is

We work hard on 53 Dock but we cannot promise it will always be available, always correct, or always up to date. It is provided "as is", without warranties of any kind, to the fullest extent the law allows.

To the extent the law allows, we are not liable for losses arising from your use of the app — including a load you did not take, a delivery you missed, or a decision you made based on something you read here. Nothing in these terms limits liability that cannot legally be limited.

9. Ending it

You can delete your account whenever you like, from the Account screen.

We can suspend or close an account that breaks these terms. If we close yours for a reason other than a serious breach, we will tell you why.

10. The legal bits

These terms are governed by the laws of the State of Washington, without regard to conflict of law rules. Disputes go to the state or federal courts in Washington.

If part of these terms turns out to be unenforceable, the rest still stands.

We may change these terms. If a change materially affects you, we will say so in the app before it takes effect.
